European Sick Leave Ruling

12th August 2012
story image

If a worker becomes unfit for work during a period of paid holiday, they are entitled to take paid time off at a later date to compensate, the European Court of Justice has ruled. In the case of Association Nacional de Grandes Empresas de Distribution (ANGED) v Federación de Asociacones Sindicales (FASGA) and others (C-78/11) the court decided that the entitlement applies irrespective of the point at which the incapacity for work occurred. For details of this case or to discuss the impact of this ruling on your business, please contact one of our advisers.
